5    AN ACT RELATING TO STATE INSTITUTIONS; CREATING THE GOAL FOR THE
6    DEPARTMENT OF CORRECTIONS OF HAVING ALL ELIGIBLE INMATES
7    PRODUCTIVELY INVOLVED IN A TREATMENT, EDUCATION, OR WORK PROGRAM.
8    This act affects sections of Utah Code Annotated 1953 as follows:
9    AMENDS:
10         64-9b-1, as enacted by Chapter 32, Laws of Utah 1978
11    Be it enacted by the Legislature of the state of Utah:
12        Section 1. Section 64-9b-1 is amended to read:
13         64-9b-1. Legislative findings.
14        (1) The Legislature finds that it is in the best interest of the state of Utah for the
15    department to:
16        (a) develop job opportunities to further enhance the rehabilitation of inmates of the Utah
17    state prison[.];
18        (b) establish and actively work toward the goal that all inmates, except those precluded
19    by the terms of the judgment and sentence under which they are confined, shall be productively
20    involved in a treatment, education, or work program, or a combination of these programs, as
21    appropriate; and
22        (c) submit a comprehensive management plan outlining the department's plan to meet this
23    goal to the Legislature on or before November 1 of each even-numbered year, and the plan shall
24    include:
25        (i) a cost-effective analysis of current inmate education, treatment, and work programs;
26    and
27        (ii) a study of the feasibility of expanding inmate work programs, particularly in regard


1    to programs that:
2        (A) are not capital intensive;
3        (B) do not compete with existing Utah industry; and
4        (C) are designed to increase the motivation, develop the work capabilities, and foster the
5    cooperation of inmates.
6        (2) The Legislature further finds that a proper means to accomplish this is through a liberal
7    application of this act.
