5    AN ACT RELATING TO CHILD AND FAMILY SERVICES; PROVIDING FOR THE
6    COLLECTION OF THE MEDICAL, MENTAL HEALTH, AND SOCIAL HISTORIES OF
7    A CHILD TAKEN INTO THE CUSTODY OF THE DIVISION OF CHILD AND FAMILY
8    SERVICES; REQUIRING THE DIVISION TO COMMUNICATE ALL INFORMATION
9    ABOUT A CHILD IN ITS CUSTODY TO ANY PERSON PROVIDING OUT OF HOME
10    PLACEMENT.
11    This act affects sections of Utah Code Annotated 1953 as follows:
12    ENACTS:
13         62A-4a-205.4, Utah Code Annotated 1953
14    Be it enacted by the Legislature of the state of Utah:
15        Section 1. Section 62A-4a-205.4 is enacted to read:
16         62A-4a-205.4. Medical history -- Collection -- Use.
17        (1) Beginning immediately after taking a child into protective custody, the division shall
18    collect from the parent, guardian, relatives, the child's school or school district, or other persons
19    who may reasonably be able to provide it, the following information:
20        (a) the child's medical history, including:
21        (i) illnesses;
22         (ii) diagnostic tests; and
23        (iii) drug treatments, therapies, surgeries, and other interventions; and
24        (b) the child's social and mental health history, including:
25        (i) mental illnesses;
26        (ii) diagnostic assessments;
27        (iii) any history of sexual abuse or of perpetrating acts of sexual abuse on any other


1    person; and
2        (iv) drug treatments, counseling, therapies, and other interventions.
3        (2) The division shall ensure that the information collected under Subsection (1) and all
4    other information about a child's physical, social, and mental health in the possession of the
5    division is communicated to any prospective:
6        (a) foster parent;
7        (b) adoptive parent;
8        (c) guardian; and
9        (d) other person providing out of home placement for the child.
