6    AN ACT RELATING TO INSURANCE; REQUIRING THE COMMISSIONER ESTABLISH
7    MINIMUM STANDARDS OF COVERAGE FOR DIABETES; AND PROVIDING AN
8    EFFECTIVE DATE.
9    This act affects sections of Utah Code Annotated 1953 as follows:
10    ENACTS:
11         31A-22-623, Utah Code Annotated 1953
12    Be it enacted by the Legislature of the state of Utah:
13        Section 1. Section 31A-22-623 is enacted to read:
14         31A-22-623. Coverage of diabetes.
15        (1) As used in this section, "diabetes" includes individuals with:
16        (a) complete insulin deficiency or type l diabetes;
17        (b) insulin resistant with partial insulin deficiency or type 2 diabetes; and
18        (c) elevated blood glucose levels induced by pregnancy or gestational diabetes.
19        (2) The commissioner shall establish, by rule, minimum standards of coverage for diabetes
20    for disability insurance policies that provide a health insurance benefit.
21        (3) In making rules under Subsection (2), the commissioner shall require rules:
22        (a) with durational limits, amount limits, deductibles, and coinsurance for diabetes
23    equitable or identical to coverage provided for other illnesses or diseases; and
24        (b) that provide coverage for:
25        (i) diabetes self-management education or medical nutritional therapy in a program
26    approved by the department in accordance standards adopted by rule; and
27        (ii) equipment, supplies, appliances, and drugs prescribed to treat diabetes when medically

2        Section 2. Effective date.
3        This act takes effect on July 1, 1998.
