6    REVIEW SELECTED STATE GOVERNMENT ENTITIES' BUDGETS AND MAKE
7    RECOMMENDATIONS; SPECIFYING TASK FORCE MEMBERSHIP AND DUTIES;
8    PROVIDING A $79,000 APPROPRIATION; h [ REPEALING PROVISIONS ESTABLISHING
9    A LEGISLATIVE PROCESS COMMITTEE;

AND PROVIDING AN EFFECTIVE DATE.
10    This act affects sections of Utah Code Annotated 1953 as follows:
11    ENACTS:

19    Be it enacted by the Legislature of the state of Utah:
20        Section 1. Section 36-23-1 is enacted to read:
21         36-23-1. Budget Review Task Force -- Creation -- Membership -- Quorum --
22     Compensation -- Staffing.
23        (1) There is created the Budget Review Task Force consisting of the following 13
24    members:
25        (a) five members of the Senate, three from the majority party and two from the minority
26    party, appointed by the president of the Senate; and
27        (b) eight members of the House of Representatives, five from the majority party and three

1    from the minority party, appointed by the speaker of the House.
2        (2) (a) The president of the Senate shall appoint one of the Senate members to be a cochair
3    of the task force.
4        (b) The speaker of the House shall appoint one of the House members to be a cochair of
5    the task force.
6        (c) Members shall serve for a one-year term or until their successors are appointed.
7        (d) (i) A vacancy exists whenever a committee member ceases to be a member of the
8    Legislature or when a member resigns from the committee.
9        (ii) Vacancies shall be filled by the appointing authority, and the replacement shall serve
10    out the unexpired term.
11        (3) In conducting all of its business, the committee shall comply with the rules of
12    legislative interim committees.
13        (4) The Office of the Legislative Fiscal Analyst shall provide staff services to the task
14    force.
15        Section 2. Section 36-23-2 is enacted to read:
16         36-23-2. Task force duties.
17        Each year, the task force shall:
18        (1) study the budget of the department or division of state government selected by the
19    Legislative Management Committee;
20        (2) review the programs and functions of that department or division and consider whether
21    any or all of them are still necessary;
22        (3) review the department's or division's personnel structure and determine whether or not
23    the department or division may adequately perform its responsibilities with fewer employees;
24        (4) make recommendations, and prepare draft legislation where appropriate, to eliminate
25    programs, reduce or eliminate program budgets, and reduce department or division employees; and
26        (5) report its findings and recommendations to the Executive Appropriations Committee
27    before December 31 of each year.
28         h [ Section 3. Repealer.
29        This act repeals:
30        Section 36-17-1, Legislative Process Committee -- Membership.
31        Section 36-17-2, Committee duties.

3        Section h [ 4 ] 3 h . Appropriation.
4        There is appropriated from the General Fund for fiscal year 1998-99:
5        (1) $6,000 to the Senate to pay for the compensation and expenses of senators who are
6    members of the task force;
7        (2) $9,500 to the House to pay for the compensation and expenses of representatives who
8    are members of the task force; and
9        (3) $63,500 to the Office of the Legislative Fiscal Analyst for staffing expenses associated
10    with the task force.
11        Section h [ 5 ] 4 h . Effective date.
12        If approved by two-thirds of all the members elected to each house, this act takes effect
13    upon approval by the governor, or the day following the constitutional time limit of Utah
14    Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
15    date of veto override.
