5    AN ACT RELATING TO MOTOR VEHICLES; PROHIBITING CERTAIN USES OF RADAR
6    JAMMING DEVICES; PROVIDING EXCEPTIONS; AND PROVIDING PENALTIES.
7    This act affects sections of Utah Code Annotated 1953 as follows:
8    ENACTS:
9         41-6-52.7, Utah Code Annotated 1953
10    Be it enacted by the Legislature of the state of Utah:
11        Section 1. Section 41-6-52.7 is enacted to read:
12         41-6-52.7. Radar jamming devices and jamming radar prohibited -- Defense --
13     Exceptions -- Penalties.
14        (1) As used in this section, "radar jamming device" means any instrument or mechanism
15    designed or intended to interfere with the radar or any laser that is used by law enforcement
16    personnel to measure the speed of a motor vehicle on a highway.
17        (2) (a) A person may not operate a motor vehicle on a highway with a radar jamming
18    device in the motor vehicle.
19        (b) A person may not knowingly use a radar jamming device to interfere with the radar
20    signals or lasers used by law enforcement personnel to measure the speed of a motor vehicle on
21    a highway.
22        (3) It is an affirmative defense to a charge under Subsection (2)(a) that the radar jamming
23    device was in an inoperative condition S [and] OR s could not be readily S [made operative]
23a     USED s at the time of the
24    arrest or citation.
25        (4) This section does not apply to law enforcement personnel acting in their official
26    capacity.
