6 AN ACT RELATING TO PUBLIC EDUCATION; REQUIRING AN EVALUATION OF A
7 PROVISIONAL EDUCATOR IN THE FIRST AND SECOND HALF OF EACH CONTRACT
8 YEAR; AND PROVIDING A PENALTY FOR FAILURE TO CONDUCT THE
9 EVALUATIONS.
10 This act affects sections of Utah Code Annotated 1953 as follows:
11 AMENDS:
12 53A-10-104, as enacted by Chapter 2, Laws of Utah 1988
13 Be it enacted by the Legislature of the state of Utah:
14 Section 1. Section 53A-10-104 is amended to read:
15 53A-10-104. Frequency of evaluations.
16 (1) A local school board shall provide for the evaluation of its provisional and probationary
17 educators at least twice each school year.
18 (2) The first evaluation of a provisional educator shall take place during the first half of
19 the provisional educator's contract year.
20 (3) Another evaluation shall take place during the second half of the provisional educator's
21 contract year.
22 (4) The State Office of Education shall withhold the transfer of $1,000 from the Uniform
23 School Fund to which a school district would otherwise be entitled for each failure to conduct an
24 evaluation of a provisional educator as required under this section.
