HANDGUN PURCHASE REQUIREMENTS

Representative Killpack proposes the following amendments:
1. Page 1, Line 1: At the beginning of line 1 delete "HANDGUN" and insert "FIREARM"
2. Page 1, Line 7: At the beginning of line 7 delete "HANDGUN" and insert "FIREARM"
3. Page 1, Line 11: After "DEFINITION;" insert "GIVING THE DIVISION AUTHORITY TO MAKE RULES TO EXTEND BACKGROUND CHECKS TO OTHER FIREARMS WHEN THE FEDERAL LAW GOES INTO EFFECT; PROVIDING A COORDINATION CLAUSE;"
4. Page 2, Line 22: After "Infractions" delete "may" and insert "shall"
5. Page 3, Line 28: After "76-10-503" insert "and federal law"
6. Page 6, Line 1: After line 1 insert:
"(1) A criminal background check required by this section shall only apply to the purchase of a handgun until federal law requires the background check to extend to other firearms.
(2) At the time that federal law extends the criminal background check requirement to other firearms, the division shall make rules to extend the background checks required under this section to the other firearms.
Renumber remaining subsections accordingly.

Section 5. Coordination Clause.
It is the intent of the Legislature that, except for page 7 line 23, any place on pages 6, 7, and 8 where the term "handgun" is used it should be bracketed and "firearm" inserted accordingly.
