6 AN ACT RELATING TO WILDLIFE RESOURCES; REQUIRING A RESIDENT TO POSSESS
7 A CERTIFICATION OF REGISTRATION TO HOLD A FALCON AND ENGAGE IN THE
8 SPORT OF FALCONRY; SETTING FEES FOR A FALCONRY CERTIFICATE OF
9 REGISTRATION; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A REPEAL
10 DATE.
11 This act affects sections of Utah Code Annotated 1953 as follows:

13 23-19-16, as last amended by Chapter 242, Laws of Utah 1998
14 23-19-34.5, as last amended by Chapter 242, Laws of Utah 1998
15 23-19-40, as last amended by Chapter 242, Laws of Utah 1998
16 ENACTS:
17 23-19-46, Utah Code Annotated 1953
18 Be it enacted by the Legislature of the state of Utah:
19 Section 1. Section 23-19-16 is amended to read:
20 23-19-16. Licenses obtained from agents of division.
21 (1) Licenses provided for in Sections 23-19-17 through 23-19-27 and 23-19-42 may be
22 obtained from the division or one of its authorized wildlife license agents.
23 (2) Licenses provided for in Sections 23-19-17.5 , [
24 23-19-37 may be obtained only from the division.
25 Section 2. Section 23-19-34.5 is amended to read:
26 23-19-34.5. Falconry certificate of registration -- Residents 14 or older may obtain
27 certificate of registration -- License for falconry meet for nonresidents -- Wildlife Board
28 approval required for falconry meet -- Small game license required to take protected game.
29 (1) Any resident 14 years of age or older, upon [

31 falcons and engage in the sport of falconry on nongame wildlife species.
32 (2) A nonresident entering Utah to participate in the sport of falconry at an organized meet
33 shall obtain a license as provided in Section 23-19-34.7 .
34 (3) Organizers of a falconry meet must apply to and receive approval from the Wildlife
35 Board in order to conduct an organized falconry meet.
36 (4) (a) Any person engaging in the sport of falconry on protected small game species shall
37 possess, in addition to the falconry h [
37a taking small game.
38 (b) Any nonresident who has been issued a license pursuant to Section 23-19-34.7 is not
39 required to possess a small game license in order to take small game during the five-day period of
40 the license.
41 Section 3. Section 23-19-40 is amended to read:
42 23-19-40. Fees for licenses.
43 (1) Residents and nonresidents may engage in hunting, fishing, trapping, bird hunting in
44 commercial areas, and falconry upon obtaining a license through the payment of one or more of
45 the following applicable fees:

69 (2) Statewide fish stamps or fees may not be imposed without legislative approval.
70 Section 4. Section 23-19-46 is enacted to read:
71 23-19-46. Fees for falconry certificate of registration.
72 Notwithstanding the requirements for the setting of fees in Sections 63-34-5 and 63-38-3.2 ,
73 fees for a certificate of registration to hold a falcon and engage in the sport of falconry shall be:
74 (1) $15 for a one-year certificate of registration;
75 (2) $30 for a two-year certificate of registration; and
76 (3) $45 for a three-year certificate of registration.
77 Section 5. Effective date.
78 This act takes effect on January 1, 2000.
79 Section 6. Repeal date.
80 Section 23-19-46 is repealed July 1, 2000.
