6 AN ACT RELATING TO MOTOR VEHICLES; ALLOWING PEACE OFFICERS TO FILE
7 COPIES OF ACCIDENT REPORTS TO THE DEPARTMENT OF PUBLIC SAFETY.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 AMENDS:
10 41-6-35, as last amended by Chapter 174, Laws of Utah 1996
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 41-6-35 is amended to read:
13 41-6-35. Accident reports -- Duty of operator and investigative officer to forward or
14 render.
15 (1) The department may require any operator of a vehicle involved in an accident resulting
16 in injury to or death of any person or total property damage to the apparent extent of $1,000 or
17 more to forward within ten days after the request:
18 (a) a written report of the accident to the department; and
19 (b) a supplemental report when the original report is insufficient in the opinion of the
20 department.
21 (2) The department may require witnesses of accidents to render reports to the department.
22 (3) A written accident report is not required under this section from any person who is
23 physically incapable of making a report, during his period of incapacity.
24 (4) (a) Every peace officer who in the regular course of duty investigates a motor vehicle
25 accident described under Subsection (1) shall file the original, an electronic copy, or photocopy
26 of the report of the accident with the department within ten days after completing the investigation.
27 (b) The report shall be made either at the time of and at the scene of the accident or later
28 by interviewing participants or witnesses.
29 (5) The written reports required to be filed with the department by peace officers and the
30 information in them are not privileged or confidential.
