6 AN ACT RELATING TO MOTOR VEHICLES; PROVIDING CERTAIN DEFINITIONS;
7 PROVIDING CERTAIN EXCEPTIONS TO AGE RESTRICTIONS FOR CERTAIN
8 OFF-HIGHWAY VEHICLES; AND PROVIDING CERTAIN REQUIREMENTS FOR
9 PRACTICES AND RACES.
10 This act affects sections of Utah Code Annotated 1953 as follows:
11 AMENDS:
12 41-22-29, as last amended by Chapter 21, Laws of Utah 1989
13 Be it enacted by the Legislature of the state of Utah:
14 Section 1. Section 41-22-29 is amended to read:
15 41-22-29. Operation by persons under eight years of age prohibited -- Definitions --
16 Exception -- Penalty.
17 (1) [
18 (a) "Organized practice" means a scheduled motorcycle practice held in an off-road vehicle
19 facility designated by the division and conducted by an organization carrying liability insurance
20 in at least the amounts specified by the division under Subsection (5) covering all activities
21 associated with the practice.
22 (b) "Sanctioned race" means a motorcycle race conducted on a closed course and
23 sponsored and sanctioned by an organization carrying liability insurance in at least the amounts
24 specified by the division under Subsection (5) covering all activities associated with the race.
25 (2) Except as provided under Subsection (3), a person under eight years of age may not
26 operate and [
27 to operate an off-highway vehicle on any public land, trail, street, or highway of this state.
28 (3) A child under eight years of age may participate in a sanctioned race or organized
29 practice if:
30 (a) the child is under the immediate supervision of an adult;
31 (b) advanced life support personnel, as defined in Section 26-8-2 , are on the premises and
32 immediately available to provide assistance at all times during the sanctioned race or organized
33 practice; and
34 (c) ambulance service, as defined in Section 26-8-2 , is on the premises and immediately
35 available to provide assistance for a sanctioned race.

37 shall be fined not more than $50 per offense.
38 (5) In accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking Act, the
39 division shall make rules specifying the minimum amounts of liability coverage for an organized
40 practice or sanctioned race.
