6 AN ACT RELATING TO THE AUTOMATED GEOGRAPHIC REFERENCE CENTER;
7 CREATING A COMMITTEE WITHIN THE AUTOMATED GEOGRAPHIC REFERENCE
8 CENTER TO AWARD GRANTS TO COUNTIES TO INVENTORY AND MAP R.S. 2477
9 RIGHTS-OF-WAY USING GLOBAL POSITIONING SYSTEM TECHNOLOGY AND TO
10 PHOTOGRAPH ROADS, EVIDENCE OF VALID AND EXISTING RIGHTS, AND OTHER
11 STRUCTURES ON FEDERAL LANDS; APPROPRIATING $500,000 FROM THE GENERAL
12 FUND IN FISCAL YEAR 1998-99 FOR THE GRANTS; AND PROVIDING AN EFFECTIVE
13 DATE.
14 This act affects sections of Utah Code Annotated 1953 as follows:
15 ENACTS:
16 63A-6-204, Utah Code Annotated 1953
17 Be it enacted by the Legislature of the state of Utah:
18 Section 1. Section 63A-6-204 is enacted to read:
19 63A-6-204. Committee to award grants to counties -- Inventory and mapping of R.S.
20 2477 rights-of-way -- Photographing of roads, evidence of valid and existing rights, and other
21 structures on public lands.
22 (1) There is created within the center a committee to award grants to counties to inventory
23 and map R.S. 2477 rights-of-way, associated structures, and other features as provided by
24 Subsection (5).
25 (2) (a) The committee shall consist of:
26 (i) the center manager;
27 (ii) a representative of the Governor's Office of Planning and Budget;
28 (iii) a representative of Utah State University Extension;
29 (iv) a representative of the Utah Association of Counties; and
30 (v) three county commissioners.
31 (b) The committee members specified in Subsections (2)(a)(ii) through (2)(a)(iv) shall be
32 selected by the organizations they represent.
33 (c) The committee members specified in Subsection (2)(a)(v) shall be:
34 (i) selected by the Utah Association of Counties;
35 (ii) from rural counties; and
36 (iii) from different regions of the state.
37 (3) (a) The committee shall select a chair from its membership.
38 (b) The committee shall meet upon the call of the chair or a majority of the committee
39 members.
40 (c) Four members shall constitute a quorum.
41 (4) (a) Committee members who are state government employees shall receive no
42 additional compensation for their work on the committee.
43 (b) Committee members who are not state government employees shall receive no
44 compensation or expenses from the state for their work on the committee.
45 (5) (a) The committee shall award grants to counties to:
46 (i) inventory and map R.S. 2477 rights-of-way using Global Position System (GPS)
47 technology; and
48 (ii) photograph:
49 (A) roads and other evidence of construction of R.S. 2477 rights-of-way;
50 (B) structures or natural features that may be indicative of the purpose for which an R.S.
51 2477 right-of-way was created, such as mines, agricultural facilities, recreational facilities, or
52 scenic overlooks; and
53 (C) evidence of valid and existing rights on federal lands, such as mines and agricultural
54 facilities.
55 (b) (i) The committee may allow counties, while they are conducting the activities
56 described in Subsection (5)(a), to use grant monies to inventory, map, or photograph other natural
57 or cultural resources.
58 (ii) Activities funded under Subsection (5)(b)(i) must be integrated with existing programs
59 underway by state agencies, counties, or institutions of higher education.
60 (c) Maps and other data acquired through the grants shall become a part of the State
61 Geographic Information Database.
62 (6) (a) The committee shall develop a request for proposals process and issue a request for
63 proposals.
64 (b) The request for proposals shall require each grant applicant to submit an
65 implementation plan and identify any monetary or in-kind contributions from the county.
66 (c) In awarding grants, the committee shall give priority to proposals to inventory, map,
67 and photograph R.S. 2477 rights-of-way and other structures as specified in Subsection (5)(a)
68 which are located on federal lands that:
69 (i) a federal land management agency proposes for special management, such as lands to
70 be managed as an area of critical environmental concern or primitive area; or
71 (ii) are proposed to receive a special designation by Congress, such as lands to be
72 designated as wilderness or a national conservation area.
73 Section 2. Appropriation.
74 (1) Except as provided in H.B. 4, Appropriations Coordination Act, there is appropriated
75 $500,000 from the General Fund in fiscal year 1998-1999 to the Automated Geographic Reference
76 Center to award grants to counties as provided in Section 63A-6-204.
77 (2) The money appropriated in Subsection (1) is nonlapsing.
78 Section 3. Effective date.
79 If approved by two-thirds of all the members elected to each house, this act takes effect
80 upon approval by the governor, or the day following the constitutional time limit of Utah
81 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
82 date of veto override.
