             6      A JOINT RESOLUTION OF THE LEGISLATURE ENCOURAGING THE GOVERNOR AND
             7      THE CONGRESS TO SUPPORT MEASURES TO ALLOW THE STATE OF UTAH TO
             8      ADMINISTER PROGRAMS TO PROTECT ITS CITIZENS' HEALTH AND THE
             9      ENVIRONMENT, WHILE FOSTERING ECONOMIC GROWTH.
             10      Be it resolved by the Legislature of the state of Utah:
             11          WHEREAS, the State of Utah has a long and distinguished history of leadership in
             12      protecting the health, welfare, and environment of its citizens;
             13          WHEREAS, the State of Utah is equipped to administer programs for the protection of
             14      health and environmental quality, including the permitting and regulation of sources of air and
             15      water pollution and facilities for the storage, treatment, and disposal of waste;
             16          WHEREAS, in Senate Concurrent Resolution 11, Resolution Regarding N.R.C. Action
             17      Regarding Disposal of Uranium By-Product, passed in the 1994 General Session of the Utah
             18      Legislature, the Legislature protested the authorization by the United States Nuclear Regulatory
             19      Commission to allow the receipt and processing of radioactive waste at the White Mesa uranium
             20      mill;
             21          WHEREAS, the Legislature of the State of Utah, the governor of the state, the state
             22      attorney general, and the state Department of Environmental Quality are contesting the proposed
             23      storage of spent nuclear fuel on the Goshute Indian Reservation; and
             24          WHEREAS, the foregoing are but two of many examples of how the federal government
             25      has ignored the concerns of the people of the State of Utah with regard to protection of the health
             26      and the environment of its citizens:
             27          NOW, THEREFORE, BE IT RESOLVED that the Legislature of the State of Utah strongly


             28      urges the Governor, the Department of Environmental Quality, the Department of Natural
             29      Resources, and other Utah departments and agencies, as appropriate, to preserve, strengthen, and
             30      implement the State of Utah's rights to protect the health and environment of its citizens through
             31      the acceptance of primacy agreement state status, and other appropriate delegated authority from
             32      the federal government under the federal laws governing protection of public health and the
             33      environment.
             34          BE IT FURTHER RESOLVED that the Legislature of the State of Utah strongly urges the
             35      members of the United States Congress representing the State of Utah to promote and support
             36      legislation to preserve and enhance the rights of the State of Utah to protect the health and
             37      environment of its citizens.
