Second Substitute S.B. 80

Senator R. Mont Evans proposes to substitute the following bill:

             5      AN ACT RELATING TO HIGHER EDUCATION; PROVIDING THAT FULL-TIME FACULTY
             6      AT HIGHER EDUCATION INSTITUTIONS SHALL RECEIVE TUITION REIMBURSEMENT
             7      FOR PROFESSIONAL DEVELOPMENT CLASSES TO WHICH THEY HAVE BEEN
             8      ADMITTED; PROVIDING A $27,000 APPROPRIATION FOR THE REIMBURSEMENT
             9      PROGRAM; AND PROVIDING AN EFFECTIVE DATE.
             10      This act affects sections of Utah Code Annotated 1953 as follows:
             11      ENACTS:
             12          53B-8-105, Utah Code Annotated 1953
             13      Be it enacted by the Legislature of the state of Utah:
             14          Section 1. Section 53B-8-105 is enacted to read:
             15          53B-8-105. Tuition reimbursement for full-time faculty.
             16          (1) A full-time faculty member at a state institution of higher education who enrolls in a
             17      graduate level class at any university within the state system of higher education shall receive
             18      reimbursement from the board for one-half of the tuition paid for the class, if:
             19          (a) the class is in a graduate program to which the faculty member has been admitted by
             20      the university; and
             21          (b) the faculty member's employing institution verifies that the program and the class are
             22      appropriate professional development for the faculty member.
             23          (2) In accordance with Title 63, Chapter 46a, Utah Administrative Rulemaking Act, the
             24      board shall adopt rules regarding the application process by which faculty members shall receive
             25      tuition reimbursement under this section.


             26          Section 2. Appropriation.
             27          Except as provided in H.B. 4, Appropriations Coordination Act, there is appropriated from
             28      the General Fund for fiscal year 1999-2000, $27,000 to the State Board of Regents for the tuition
             29      reimbursement program established under Section 53B-8-105 .
             30          Section 3. Effective date.
             31          This act takes effect on July 1, 1999.
