6 AN ACT RELATING TO AGRICULTURE; SPECIFYING THE CONTENTS AND USES OF
7 THE AGRICULTURE RESOURCE DEVELOPMENT FUND; APPROPRIATING $2,000,000
8 FROM THE AGRICULTURE RESOURCE DEVELOPMENT FUND FOR FISCAL YEAR
9 1998-99 TO THE RURAL REHABILITATION FUND; MAKING TECHNICAL
10 AMENDMENTS; AND PROVIDING AN EFFECTIVE DATE.
11 This act affects sections of Utah Code Annotated 1953 as follows:
12 AMENDS:
13 4-18-6, as last amended by Chapter 10, Laws of Utah 1997
14 Be it enacted by the Legislature of the state of Utah:
15 Section 1. Section 4-18-6 is amended to read:
16 4-18-6. Agriculture Resource Development Fund -- Contents -- Use of fund monies.
17 (1) There is [

19 (2) The Agriculture Resource Development Fund shall consist of [
20 (a) money appropriated to it by the Legislature[
21
22 (b) sales and use tax receipts transferred to the fund pursuant to Section 59-12-103 ;
23 (c) money received for the repayment of loans made from the fund;
24 (d) money made available to the state for agriculture resource development from any
25 source [
26 (e) interest [
27 (2) The commission shall make loans from the Agriculture Resource Development Fund
28 as provided by Section 4-18-5 .
29 (3) For fiscal year 1998-99, up to $2,000,000 in the Agriculture Resource Development
30 Fund may be appropriated by the Legislature to the Rural Rehabilitation Fund created in Section
31 4-19-4 .
32 Section 2. Appropriation.
33 (1) Except as provided in H.B. 4, Appropriations Coordination Act, there is appropriated
34 $2,000,000 from the Agriculture Resource Development Fund created in Section 4-18-6 for fiscal
35 year 1998-99 to the Rural Rehabilitation Fund created in Section 4-19-4 .
36 (2) The money appropriated in Subsection (1) is nonlapsing.
37 Section 3. Effective date.
38 If approved by two-thirds of all the members elected to each house, this act takes effect
39 upon approval by the governor, or the day following the constitutional time limit of Utah
40 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
41 date of veto override.
