DISARMING A PEACE OFFICER

5 AN ACT RELATING TO CRIMINAL CODE; CREATING THE CRIME; AND PROVIDING
6 A PENALTY OF DISARMING A PEACE OFFICER.
7 This act affects sections of Utah Code Annotated 1953 as follows:
8 ENACTS:
9 76-5-102.8, Utah Code Annotated 1953
10 Be it enacted by the Legislature of the state of Utah:
11 Section 1. Section 76-5-102.8 is enacted to read:
12 76-5-102.8. Disarming a peace officer.
13 A person is guilty of a first degree felony who intentionally takes or removes, or attempts
14 to take or remove, a firearm from the person or immediate presence of a person he knows is a
15 peace officer:
16 (1) without the consent of the peace officer; and
17 (2) while the peace officer is acting within the scope of his authority as a peace officer.
