6 AN ACT RELATING TO MOTOR VEHICLES; EXPANDING ACCESS TO ACCIDENT
7 REPORTS; AUTHORIZING FEES FOR SUPPLEMENTAL REPORTS; CREATING A
8 DEDICATED REVENUE FUND FOR THOSE FEES; SPECIFYING THE USE OF THOSE
9 FEES; AND MAKING TECHNICAL CORRECTIONS.
10 This act affects sections of Utah Code Annotated 1953 as follows:
11 AMENDS:
12 41-12a-202, as enacted by Chapter 242, Laws of Utah 1985
13 Be it enacted by the Legislature of the state of Utah:
14 Section 1. Section 41-12a-202 is amended to read:
15 41-12a-202. Access to accident reports.
16 (1) Accident reports and supplemental information as required under this chapter are for
17 the confidential use of the department and other state agencies as provided in Section 41-6-40 .

19 (2) The department shall disclose accident reports and accompanying data to persons
20 suffering loss or injury in any motor vehicle accident, whether or not they have deposited proof
21 of owner's or operator's security under this chapter.
22 (3) Any person entitled to the disclosure of an accident report or related supplemental
23 documents may obtain [

25 (4) The proceeds received from the sale of accident reports and related supplement
26 documents under this section shall be deposited as dedicated credits to be used by the Utah
27 Highway Patrol Accident Program.
28 (5) Bona fide representatives of persons entitled to disclosure may also obtain copies of
29 accident reports and any accompanying data.
