WRONGFUL APPROPRIATIONS AMENDMENTS

5 AN ACT RELATING TO THE CRIMINAL CODE; PROVIDING THAT IT IS A CRIME TO
6 WRONGFULLY APPROPRIATE PUBLICATIONS OFFERED FREE OF CHARGE; AND
7 ENACTING RELATED PROVISIONS.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 ENACTS:
10 76-6-404.6, Utah Code Annotated 1953
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 76-6-404.6 is enacted to read:
13 76-6-404.6. Wrongful appropriation of publications offered free of charge.
14 (1) Any person is guilty of wrongful appropriation who takes more than one copy of a
15 publication offered free to the public on the face of which publication notice is prominently
16 displayed that taking only one free copy per person is permitted.
17 (2) The value of each copy of a publication offered to the public free of charge shall be the
18 cost of the copy, including all fixed and variable costs.
19 (3) Multiple violations within a 30-day period may be aggregated into a single offense, and
20 the degree of the offense is determined by the total value of all the copies taken.
