Mr. Speaker:
The Government Operations Committee reports a favorable recommendation on H.B. 399, PROPERTY TAX APPORTIONMENT FOR CERTAIN PROPERTY, by Representative S. Allen, with the following amendments:
1. Page 1, Line 20: After "PROVIDING" delete "AN EFFECTIVE DATE" and insert "FOR RETROSPECTIVE OPERATION"
2. Page 3, Line 65: After "means a tax area" delete "located within" and insert "created by the overlapping boundaries of only the following taxing entities: (i) a county; and (ii)"
3. Page 3, Line 66: After "(b)" insert "Notwithstanding Subsection (9)(a)," and after the first quotation mark delete "Designated" and insert "designated" and after "tax area"" insert "includes a tax area created by the overlapping boundaries of: (i) the taxing entities described in Subsection (9)(a); and (ii)(A) a city or town if the boundaries of the school district under Subsection (9)(a) and the boundaries of the city or town are identical; or (B) a special service district if the boundaries of the school district under Subsection (9)(a) are located entirely within the special service district" and then delete the remainder of Line 66
4. Page 3, Lines 67-68: Delete Lines 67-68 except for the period
5. Page 7, Line 196: After "apportion" bracket "the"
6. Page 9, Line 272: After "Section 3." delete " Effective date" and insert " Retrospective operation"
7. Page 9, Line 273: After "act" delete "takes effect on" and insert "has retrospective operation to" and after "January 1," delete "2000" and insert "1999"
