Mr. President and Mr. Speaker:
Your Conference Committee consisting of Senators Spencer, Suazo, and Montgomery, and Representatives Bennion, Goodfellow, and Swallow to which was referred 1st Sub. S.B. 208, Cohabitant Abuse Act Amendments by Senator Terry Spencer, proposes the following amendments:
1. Amend Page 4 of the Lilac copy dated 3-3-99 as follows:
Line 96: Delete "shall" and insert "may include, but not be limited to, other evidence such as police reports, medical reports, or third party affidavits."
Lines 99a & 99b: Delete lines 99a and 99b
2. Amend Page 8 of the Lilac copy dated 3-3-99 as follows:
Line 222a: After line 222a, insert "Either party may request an evidentiary hearing on the question of issuance of a protective order. If an evidentiary hearing is requested, the petitioner shall provide evidence in support of issuing a protective order. That evidence may include testimony and other relevant evidence."
