                  AN ACT RELATING TO HEALTH AND HUMAN SERVICES; EXTENDING AND
                  MODIFYING THE REQUIREMENT TO STUDY THE PORTABILITY OF HEALTH AND
                  HUMAN SERVICES FUNDING.
                  This act affects uncodified material as follows:
                  AMENDS:
                  Uncodified Section 1, Chapter 16, Laws of Utah 1999
                  Be it enacted by the Legislature of the state of Utah:
                      Section 1. Uncodified Section 1, Chapter 16, Laws of Utah 1999 is amended to read:
                      Section 1. Continuation of portability study.
                      (1) [No later than the November 1998 meeting of the Health and Human Services Interim
                  Committee,] During fiscal year 2000-01 the Department of Human Services and the Division of
                  Health Care Financing within the Department of Health shall [report] continue their study of how
                  to [the committee on] increase the portability of state and federal funding to persons wishing to
                  move:
                      (a) from services provided by the Division of Health Care Financing to services provided
                  by the Department of Human Services; and
                      (b) from services provided by the Department of Human Services to services provided by
                  the Division of Health Care Financing.
                      (2) The [report] study shall [highlight]:
                      (a) focus on:
                      (i) regulatory, structural, and fiscal impediments to portability[.]; and
                      (ii) related issues, including diversion;
                      (b) address the needs of the aged, persons with a mental illness, and persons with a
                  disability;


                      (c) continue to rely on the input of persons involved in the study during the previous two
                  years; and
                      (d) include input from:
                      (i) the Division of Aging and Adult Services within the Department of Human Services;
                      (ii) persons who care for aged relatives or who are otherwise affected by aging issues; and
                      (iii) the Division of Mental Health.
                      (3) No later than [the November 1999 meeting of the Health and Human Services Interim
                  Committee,] July 31, 2001, the Department of Human Services and the Division of Health Care
                  Financing shall [provide to the committee a more detailed report with] submit a written report of their
                  study and recommendations [for increasing portability] to the Health and Human Services Interim
                  Committee and the Joint Appropriations Health and Human Services Subcommittee.
