5 AN ACT RELATING TO COUNTIES AND OTHER LOCAL GOVERNMENTS;
6 APPROPRIATING $500,000 TO THE OFFICE OF PLANNING AND BUDGET TO
7 DISTRIBUTE TO COUNTIES AND OTHER LOCAL GOVERNMENTS AS MATCHING
8 FUNDS FOR THE DEVELOPMENT AND IMPLEMENTATION OF LAND USE PLANS AND
9 TO SOUTHERN UTAH UNIVERSITY TO CONDUCT WORKSHOPS ON LAND PLANNING.
10 This act enacts uncodified material.
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Intent.
13 The Legislature finds that appropriate land-use planning by the counties and other local
14 governments is a matter of state concern and that the quality of land-use planning improves with
15 training and education. It is the intent of the Legislature in appropriating these funds to help meet
16 the statewide need for training and education of county, local, and state officials involved in
17 land-use planning activities to improve the quality of land-use planning.
18 Section 2. Appropriation.
19 (1) (a) For fiscal year 2000-01 only, there is appropriated from the General Fund $500,000
20 to the Office of Planning and Budget.
21 (b) The Office of Planning and Budget shall:
22 (i) distribute up to $10,000 of the appropriated funds to Southern Utah University for use
23 by its Utah Center for Rural Life to conduct workshops on preparation of land-use plans, including
24 protection of private property rights and other rights attached to property;
25 (ii) determine, in conjunction with the Utah Association of Counties, the counties and
26 other local governments most qualified to receive the remainder of the appropriated funds to assist
27 in developing and implementing land-use plans, based on criteria established by the Governor's
28 Local Government Comprehensive Planning Project Steering Committee;
29 (iii) consider the recommendations of the Governor's Rural Partnership Board in
30 determining the counties and other local governments most qualified to receive funds under
31 Subsection (1)(b)(ii); and
32 (iv) distribute the remaining funds to counties and other local governments that:
33 (A) meet the criteria established by the Governor's Local Government Comprehensive
34 Planning Project Steering Committee;
35 (B) match the amount distributed by the Office of Planning and Budget in funds or in kind;
36 (C) agree to encourage county, local, and state officials involved with land-use planning
37 to attend the workshops; and
38 (D) agree to review and, if necessary, revise the comprehensive general plan at least
39 annually.
40 (c) In planning and presenting the workshops provided under Subsection (1)(b)(i),
41 Southern Utah University, through its Utah Center for Rural Life, may involve county and other
42 local government officials who are preparing or have completed a land-use plan.
43 (2) These appropriations are nonlapsing.
