             6      AN ACT RELATING TO PUBLIC SCHOOLS; PROVIDING AN EXCEPTION TO THE
             7      REQUIREMENTS FOR THE PURCHASE OF EDUCATIONAL TECHNOLOGY BY SCHOOL
             8      DISTRICTS UNDER THE EDUCATIONAL TECHNOLOGY INITIATIVE.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          53A-1-706, as enacted by Chapter 235, Laws of Utah 1990
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 53A-1-706 is amended to read:
             14           53A-1-706. Purchases of educational technology.
             15          (1) (a) A school district or college of education shall comply with Title 63, Chapter 56, the
             16      Utah Procurement Code, in purchasing technology under this part except as otherwise provided
             17      in Subsection (1)(b).
             18          (b) A school district may purchase computers and contract for the repair or refurbishing
             19      of computers under the program established in Section 53A-1-707 that involves the Utah
             20      Correctional Industries without going through the bidding or competition procedures outlined in
             21      Title 63, Chapter 56, Part D, Source Selection and Contract Formation.
             22          (2) A school district or college of education may purchase technology through cooperative
             23      purchasing contracts administered by the state Division of Purchasing or through its own
             24      established purchasing program.
