Mr. President:

    The Judiciary Committee recommends S.B. 72, CRIMINAL CODE - RESTRICTED PERSONS, by Senator T. Spencer, be replaced and favorably recommends 1st Sub. S.B. 72, CRIMINAL CODE - RESTRICTED PERSONS with the following amendments:
1.    Page 3, Line 82:    After "insanity" insert "for a felony offense"

2.    Page 3, Line 83:    Delete line 83

3.    Page 3, Line 84:    At the beginning of the line delete "(h)" and insert "(g)" and after "trial" insert "for a felony offense"

         Renumber remaining subsections accordingly.

4.    Page 3, Line 86:    After "(2)" insert "current"

5.    Page 7, line 189-193:    Delete lines 189-193 and insert
        "(iii) is an unlawful user of a controlled substance as defined in Section 58-37-2;
        (iv) is in possession of a dangerous weapon and is knowingly and intentionally in unlawful possession of a controlled substance as defined in Section 58-37-2;
"

6.    Page 7, Line 194:    At the beginning of the line delete "(iv)" and insert "(v)" and after "insanity" insert "for a felony offense"

7.    Page 7, Line 195:     Delete line 195

8.    Page 7, Line 196:    After "trial" insert "for a felony offense"

9.    Page 7, Line 197:    After "(vii)" delete "has been" and insert"is currently"
