Mr. President:

    The Judiciary Committee reports a favorable recommendation on S.B. 221, SHERIFF'S CLASSIFICATION OF JAIL INMATES AND JAIL FACILITIES, by Senator M. Waddoups, with the following amendments:



1.    Page 1, Line 8:    After "SHERIFFS" insert "TO DEVELOP AND IMPLEMENT ALTERNATIVE INCARCERATION PROGRAMS; REQUIRING COUNTY SHERIFFS"

2.    Page 1, Line 20:    After "(1)" bracket "The" and insert "Except as provided in Subsection (4), the"

3.    Page 1, Line 24:    After "(2)" delete "Each" and insert "Except as provided in Subsection (4), each"

4.    Page 1, Line 26:    After "(3)(a)" delete "A" and insert "Except as provided in Subsection (4), a"

5.    Page 2, Line 30:    After line 30 insert:

        "(4) This section may not be construed to authorize a sheriff to modify provisions of a contract with the Department of Corrections

to house in a county jail persons sentenced to the Department of Corrections."
    
6.    Page 2, Line 34:    After "(1)" delete "A" and insert "Except as provided in Subsection (3), a" and after "sheriff" delete "may" and insert "shall"

7.    Page 2, Line 35:    At the beginning of line 35 delete "(a)" and insert "(i) subject to Subsection (1)(b),"

8    Page 2, Line 37:    At the beginning of line 37 delete "(b)" and insert "(ii)"

9.    Page 2, Line 38:    At the beginning of line 38 delete "(c)" and insert "(iii)"

10.    Page 2, Line 38:    At the end of line 38 insert:

        "(b) A classification under Subsection (1)(a)(i) of a jail facility may not violate any applicable zoning ordinance or conditional use permit of the county or municipality."

11.    Page 2, Line 39:    After "(2)" delete "Each" and insert "Except as provided in Subsection (3), each"

12.    Page 2, Line 40:    After "(a)" insert "with the approval of the county legislative body,"

13.    Page 2, Line 42:    After "capacity" delete ", as established by the"

14.    Page 2, Line 43:    Delete "sheriff"

15.    Page 2, Line 50:    After line 50 insert:

        "(3) This section may not be construed to authorize a sheriff to modify provisions of a contract with the Department of Corrections to house in a county jail persons sentenced to the Department of Corrections."
