             5      This act modifies provisions relating to the State System of Public Education by requiring
             6      a local school board to include the total teaching experience in Utah public schools when
             7      negotiating a contract to teach. The act permits applicants with teaching experience outside
             8      the state who are negotiating an employment contract to receive credit for 2/3 of those years.
             9      The act takes effect July 1, 2001.
             10      This act affects sections of Utah Code Annotated 1953 as follows:
             11      ENACTS:
             12          53A-3-411.5, Utah Code Annotated 1953
             13      Be it enacted by the Legislature of the state of Utah:
             14          Section 1. Section 53A-3-411.5 is enacted to read:
             15          53A-3-411.5. Teaching experience employment factor.
             16          (1) (a) In negotiating a contract of employment to teach in the state's public schools, a local
             17      school board h [shall] MAY h accept as credited experience all the years a teacher has taught in the
             17a      state's
             18      public schools.
             19           (b) Partial credit h [shall] MAY h be granted for less than a full school year of teaching under
             19a      rules
             20      made by the State Board of Education in accordance with Title 63, Chapter 46a, Utah
             21      Administrative Rulemaking Act.
             22           (2) A local school board h [shall] MAY h accept 2/3 of the documented teaching experience
             22a      earned
             23      outside the state as credited experience in negotiating a contract of employment to teach in the
             24      state's public schools.
             25          (3) Since educators are employed on the basis of outstanding professional qualifications,
             26      nothing in this section may be construed to mean that teaching experience is the only consideration
             27      in negotiating a contract of employment.
             27a      S THERE IS APPROPRIATED $336,000 FROM THE UNIFORM SCHOOL FUND TO THE STATE BOARD
             27b      OF EDUCATION. s


             28          Section 2. Effective date.
             29          This act takes effect on July 1, 2001.
