             6      This act modifies the procurement code by authorizing the use of reverse auctions to award
             7      contracts. The act requires the Procurement Policy Board to make rules to govern the
             8      reverse auction process.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      ENACTS:
             11          63-56-20.1, Utah Code Annotated 1953
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 63-56-20.1 is enacted to read:
             14          63-56-20.1. Contracts awarded by reverse auction.
             15          (1) As used in this section, "reverse auction" means a process where:
             16          (a) contracts are awarded in an open and interactive environment, which may include the
             17      use of electronic media; and
             18          (b) bids are opened and made public immediately, and bidders given opportunity to submit
             19      revised, lower bids, until the bidding process is complete.
             20          (2) (a) Notwithstanding the requirements of this chapter, contracts may be awarded
             21      through a reverse auction.
             22          (b) The policy board shall make rules, consistent with this chapter, governing a reverse
             23      auction process.
