             6      This act modifies the Volunteer Government Workers Act to expand workers' compensation
             7      coverage to volunteer auxiliary police officers and makes technical changes.
             8      This act affects sections of Utah Code Annotated 1953 as follows:
             9      AMENDS:
             10          67-20-7, as last amended by Chapter 240, Laws of Utah 1996
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Section 67-20-7 is amended to read:
             13           67-20-7. Workers' compensation benefits for volunteer firefighters.
             14          (1) In addition to the purposes set out in Subsections 67-20-3 (2) and (3), [a volunteer
             15      firefighter, as defined in Section 49-5-103 , is] the following are considered an agency employee
             16      for the purpose of receiving workers' compensation benefits under Title [35A] 34A, Chapter [3]
             17      2, Workers' Compensation Act, and Chapter [3a] 3, Utah Occupational Disease Act[.]:
             18          (a) a volunteer firefighter as defined in Section 49-5-103 ; and
             19          (b) an auxiliary police officer:
             20          (i) as defined in Section 53-13-112 ; and
             21          (ii) who is serving as a volunteer as defined in Section 67-20-2 .
             22          (2) [These] The workers' compensation benefits as described in Subsection (2) are the
             23      exclusive remedy for all injuries and occupational diseases resulting from [his] the services of an
             24      individual described in Subsection (1) provided as:
             25          (a) a volunteer firefighter; or
             26          (b) an auxiliary police officer who is serving as a volunteer. [Compensation]
             27          (3) For purposes of calculating workers' compensation benefits for an individual covered


             28      by this section, the average weekly wage rate of the following compensation shall be computed:
             29          (a) for volunteer firefighters, as indicated in Section 49-5-802 [.]; and
             30          (b) for an auxiliary police officer who is serving as a volunteer by using the lowest
             31      monthly salary of a police officer in a city of the first class in this state.
