APPROPRIATION FOR 21ST CENTURY
2 LIBRARY INITIATIVE
3 2001 GENERAL SESSION

6 This act modifies provisions related to the State Library Donation Expendable Trust Fund.
7 The act allows the fund to receive and distribute monies appropriated by the Legislature.
8 The act appropriates $2,000,000 for fiscal year 2001-02 only, from the General Fund to the
9 State Library Donation Expendable Trust Fund. The act provides an effective date.
10 AMENDS:
11 9-7-206, as renumbered and amended by Chapter 241, Laws of Utah 1992
12 Be it enacted by the Legislature of the state of Utah:
13 Section 1. Section 9-7-206 is amended to read:
14 9-7-206. State Library Donation Expendable Trust Fund -- Deposits and fees.
15 (1) There is created a trust and agency fund entitled the State Library Donation Expendable
16 Trust Fund to receive appropriations, bequests, gifts, and endowments of money.
17 (2) Any interest or proceeds realized from the use or disposition of property received by
18 the division or interest on the trust and agency fund itself shall be deposited in the State Library
19 Donation Expendable Trust Fund and used by the State Library Division for the purposes specified
20 by the donor or as directed by an appropriations act.
21 (3) All fees paid to the library and collections made due to damaged books or through sale
22 or exchange of books and other materials shall be deposited in the General Fund as dedicated
23 credits for use by the State Library Division.
24 Section 2. Appropriation.
25 (1) (a) There is appropriated from the General Fund for fiscal year 2001-02 only,
26 $2,000,000 to the State Library Donation Expendable Trust Fund created in Section 9-7-206 to be
27 used for the 21st Century Library Challenge Fund. These monies are nonlapsing.

28 (b) These funds are not available for use or distribution until the State Library Division
29 certifies to the director of the Division of Finance that an additional $8,000,000 has been raised
30 from public and private sources for the purposes outlined in Subsection (2).
31 (2) It is the intent of the Legislature that this appropriation be used to:
32 (a) assist Utah's local governments in remodeling or building new library facilities
33 adequate to meet Utah's population growth; and
34 (b) support the delivery of 21st century library services.
35 (3) Notwithstanding Subsection (1), the funds appropriated in Subsection (1) shall lapse
36 into the General Fund if an additional $8,000,000 is not raised from public and private sources by
37 December 31, 2003.
38 Section 3. Effective date.
39 This act takes effect on July 1, 2001.
