5 This act modifies the Environmental Quality Code to require the Department of
6 Environmental Quality to include, in its efforts to prevent siting of a nuclear waste facility
7 within the state, study means of economic development on Native American reservation
8 lands within the state, and provide a plan based on this study.
9 This act affects sections of Utah Code Annotated 1953 as follows:
10 ENACTS:
11 19-3-319, Utah Code Annotated 1953
12 Be it enacted by the Legislature of the state of Utah:
13 Section 1. Section 19-3-319 is enacted to read:
14 19-3-319. Efforts to prevent siting of nuclear waste facility to include economic
15 development study regarding Native American reservation lands study the economic
16 development on the Native American reservations within the state.
17 (1) It is the intent of the Legislature that the department, in its efforts to prevent the siting
18 of a nuclear waste facility within the exterior borders of the state, include in its work the study
19 under Subsection (2) and the report under Subsection (3).
20 (2) It is the intent of the Legislature that the Department of Environmental Quality, in
21 coordination with the office of the governor, and in cooperation with the Departments of
22 Community and Economic Development, Human Services, Health, Workforce Services,
23 Agriculture and Food, Environmental Quality, Natural Resources, and Transportation, the state
24 Office of Education, and the Board of Regents:
25 (a) study the needs and requirements for economic development on the Native American
26 reservations within the state; and
27 (b) prepare, on or before November 30, 2001, a long-term strategic plan for economic
28 development on the reservations.
29 (3) It is the intent of the Legislature that this plan, prepared under Subsection (2)(b) shall
30 be distributed to the governor and the members of the Legislature on or before December 31, 2001.
