GIVING FALSE INFORMATION TO POLICE

             6      This act modifies the Criminal Code by amending the offense of giving false information to
             7      a peace officer to include the specific offense of giving the name or identification of another
             8      person.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          76-8-507, as last amended by Chapter 97, Laws of Utah 1983
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 76-8-507 is amended to read:
             14           76-8-507. False personal information to peace officer.
             15          (1) A person commits a class C misdemeanor if, with intent of misleading a peace officer
             16      as to [his] the person's identity, birth date, or place of residence, [he] the person knowingly gives
             17      a false name, birth date, or address to a peace officer in the lawful discharge of [his] the peace
             18      officer's official duties.
             19           (2) A person commits a class h [[] A [ ] ] [ B ] h misdemeanor if, with the intent of S [misleading] LEADING s a
             19a      peace
             20      officer S [ as to the person's identity, birth date, or place of residence, the person knowingly or ] s
             21      S [ intentionally ] TO BELIEVE THAT THE PERSON IS ANOTHER ACTUAL PERSON, HE s gives the
             21a      name, birth date, or address of another person to a peace officer S ACTING s in the
             22      lawful discharge of the peace officer's official duties.
