             6      This act modifies the Safe Drinking Water Act to allow a public water system to supply
             7      fluoridated water to a county or municipality that has not approved fluoridation under
             8      emergency circumstances.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      ENACTS:
             11          19-4-111.2, Utah Code Annotated 1953
             12      Be it enacted by the Legislature of the state of Utah:
             13          Section 1. Section 19-4-111.2 is enacted to read:
             14          19-4-111.2. Provision of fluoridated water -- Emergency circumstances.
             15          A public water system that is simultaneously supplying water to a municipality or county
             16      that approved fluoridation in accordance with Section 19-4-111 and a municipality or county that
             17      has not approved fluoridation may provide water from its fluoridated inventory to a municipality
             18      or county that has not approved fluoridation if:
             19          (1) as a result of a short-term emergency, the only water available is from the public water
             20      system's fluoridated inventory; and
             21          (2) the public water system ceases providing fluoridated water to the municipality or
             22      county that has not approved fluoridation in accordance with Subsection 19-4-111 (1) in a time
             23      consistent with repair times following best industrial practice.
