5 This act modifies the Safe Drinking Water Act to require any substance added to public
6 water supplies for the purpose of treating disease to be approved by the United States Food
7 and Drug Administration.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 ENACTS:
10 19-4-111.5, Utah Code Annotated 1953
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 19-4-111.5 is enacted to read:
13 19-4-111.5. Restrictions on substances added to a public water supply.
14 (1) A person, agent, or agency, either public or private, may not add to a public water
15 supply, nor may a corporation or manufacturer offer for sale in this state any fluoride compound
16 intended as an additive to a public water supply that has not been approved as safe for human
17 consumption and effective for the prevention, mitigation, or treatment of disease by the United
18 States Food and Drug Administration.
19 (2) A fluoride compound used as an additive to a public water supply may not contain any
20 other substance that is regulated as a contaminant by the United States Environmental Protection
21 Agency or by the Drinking Water Board, which at maximum use levels, exceeds United States
22 Environmental Protection Agency Maximum Contaminant Level Goals.
23 (3) The requirements of this section do not apply to chlorine or other water purifying
24 agents.
