DAMAGE CAUSED BY STRAY LIVESTOCK

             5      This act modifies the Criminal Code. The act imposes a penalty on owners of livestock that
             6      cause damage to private property.
             7      This act affects sections of Utah Code Annotated 1953 as follows:
             8      ENACTS:
             9          76-6-111, Utah Code Annotated 1953
             10      Be it enacted by the Legislature of the state of Utah:
             11          Section 1. Section 76-6-111 is enacted to read:
             12          76-6-111. Stray livestock -- Infraction.
             13          (1) For purposes of this section "livestock" means an individual's cattle, sheep, llama, goat,
             14      horse, mule, ass, or swine.
             15          (2) The owner of any livestock is guilty of an infraction if the livestock:
             16          (a) are repeatedly found at large; and
             17          (b) cause damage to the private property of anyone other than the livestock's owner.
             18          (3) Subsection (2) does not apply to a resident of a county with a population density of
             19      fewer than 12 persons per square mile as measured by the last official federal census.
