First Substitute H.B. 200

Representative Patricia W. Jones proposes the following substitute bill:

NUTRITIONAL FOOD IN SCHOOLS

             5      This act amends the State System of Public Education. The act provides that after a certain
             6      time period elementary schools may sell only certain food products through vending
             7      machines on premises accessible to students.
             8      This act affects sections of Utah Code Annotated 1953 as follows:
             9      ENACTS:
             10          53A-15-1001, Utah Code Annotated 1953
             11      Be it enacted by the Legislature of the state of Utah:
             12          Section 1. Section 53A-15-1001 is enacted to read:

Part 10. Promoting Nutrition

             14          53A-15-1001. Vending machines.
             15          (1) After the date specified in Subsection (2), an elementary school may not sell, or allow
             16      to be sold, through vending machines on premises accessible to students food products other than
             17      water, milk, 100% fruit juice, or fresh fruit.
             18          (2) The requirements of Subsection (1) shall be met upon the first to occur of the
             19      following:
             20          (a) the natural expiration or earlier termination of a school's contracts in force with
             21      vending machine suppliers; or
             22          (b) three years following the effective date of this section.
