             6      This act modifies House Rules of the Fifty-fourth Legislature. This act modifies the powers
             7      of the House Rules Committee, provides standards and requirements for the motion to lift
             8      a bill from committee, and makes technical corrections. This act takes effect immediately.
             9      This resolution affects legislative rules as follows:
             10      AMENDS:
             11          HR-24.01
             12      ENACTS:
             13          HR-27.17
             14      Be it resolved by the House of Representatives of the state of Utah:
             15          Section 1. HR-24.01 is amended to read:
             16           HR-24.01. House Rules Committee.
             17          (1) All legislation introduced shall be submitted to the House Rules Committee.
             18          (2) (a) The House Rules Committee has all the powers, functions, and duties of a standing
             19      committee when it:
             20          (i) prepares the House Rules and Joint Rules and presents them to the House before
             21      adjournment on the second day of each annual general session; or
             22          (ii) reviews all House Rules or Joint Rules resolutions.
             23          (b) Rules resolutions reviewed by House Rules Committee shall be reported directly to the
             24      House for its approval, amendment, or disapproval.
             25          (c) Notwithstanding Subsection (6), when meeting as a standing committee under this
             26      Subsection (2), persons other than committee members may make comments and
             27      recommendations at the discretion of the chair.


             28          (3) For all legislation not specified in Subsection (2) that is referred to the House Rules
             29      Committee, the committee shall:
             30          (a) (i) examine each [bill] piece of legislation for proper form, including fiscal note and
             31      interim committee note, if any, and, when in proper form, order the [bills] legislation printed; and
             32          (ii) in extraordinary circumstances, recommend to the House that [a bill] legislation be
             33      printed without a fiscal note; and
             34          (b) either:
             35          (i) refer [bills] legislation to the House with a recommendation:
             36          [(i)] (A) that the legislation be referred to a standing committee for consideration; or
             37          [(ii)] (B) that the legislation be read the second time and placed on the third reading
             38      calendar; or
             39          (ii) hold the legislation.
             40          (4) In carrying out its functions and responsibilities under Subsection (3), the House Rules
             41      Committee may not:
             42          [(a) table a bill without the written consent of the sponsor;]
             43          [(b)] (a) report out any [bill] legislation that has been tabled by a standing committee;
             44          [(c)] (b) amend [a bill] legislation without the written consent of the sponsor;
             45          [(d)] (c) substitute [a bill] legislation without the written consent of the sponsor; or
             46          [(e)] (d) sponsor [a bill] legislation, except for the revisor's bill.
             47          (5) When this committee is carrying out the functions and responsibilities of Subsection
             48      (3), this committee shall:
             49          (a) during a legislative session, give notice of its meetings by either:
             50          (i) providing oral notice from the floor of the time and place of its next meeting; or
             51          (ii) when oral notice is impractical, post written notice of its next meeting;
             52          (b) when the Legislature is not in session, post a notice of meeting at least 24 hours before
             53      the meeting convenes;
             54          (c) have as its agenda all bills in its possession for assignment to committee; and
             55          (d) prepare minutes that include a record, by individual legislator, of votes taken.
             56          (6) Anyone may attend a meeting of the rules committee, but comments and discussion
             57      are limited to members of the committee.
             58          Section 2. HR-27.17 is enacted to read:


             59           HR-27.17.      Motion to Lift a Bill from Committee
             60          (1) Any member of the House may make a motion to lift a bill or resolution from a
             61      standing committee or the House Rules Committee and place it on the third reading calendar.
             62          (2) (a) Except as provided in Subsection (2)(b), if the motion is approved by a majority
             63      of the members present, the bill or resolution shall be placed on the third reading calendar.
             64          (b) During the 43, 44, and 45 day of the annual general session, and during any special
             65      session, a motion to lift a bill from committee must be approved by a vote of two-thirds of the
             66      members present.
             67          Section 3. Effective date.
             68          This resolution takes effect upon approval by a constitutional two-thirds vote of all
             69      members of the House of Representatives.
