5 This act modifies the Judicial Code, reallocating two judges from the Third District Court
6 to the Fifth District and the Third District Juvenile Court. This act takes effect July 1, 2002.
7 This act affects sections of Utah Code Annotated 1953 as follows:
8 AMENDS:
9 78-1-2.2, as last amended by Chapter 179, Laws of Utah 1998
10 78-1-2.3, as last amended by Chapter 167, Laws of Utah 1999
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 78-1-2.2 is amended to read:
13 78-1-2.2. Number of district judges.
14 The number of district court judges [
15 (1) four district judges in the First District;
16 (2) 13 district judges in the Second District;
17 (3) 30 district judges in the Third District[
18 (a) upon the retirement, resignation, or death of a judge, the number of district judges in
19 the Third District shall be decreased to 29; and
20 (b) upon the retirement, resignation, or death of a second judge, the number of district
21 judges in the Third District shall be decreased to 28;
22 (4) 12 district judges in the Fourth District;
23 (5) four district judges in the Fifth District, until the condition set forth in Subsection
24 (3)(b) is met, then the number of district judges in the Fifth District shall be increased to five;
25 (6) two district judges in the Sixth District;
26 (7) three district judges in the Seventh District; and
27 (8) two district judges in the Eighth District.
28 Section 2. Section 78-1-2.3 is amended to read:
29 78-1-2.3. Number of juvenile judges and jurisdictions.
30 The number of juvenile court judges shall be:
31 (1) two juvenile judges in the First Juvenile District;
32 (2) five juvenile judges in the Second Juvenile District;
33 (3) eight juvenile judges in the Third Juvenile District, until the condition set forth in
34 Subsection 78-1-2.2 (3)(a) is met, then the number of juvenile judges in the Third Juvenile District
35 shall be increased to nine;
36 (4) four juvenile judges in the Fourth Juvenile District;
37 (5) two juvenile judges in the Fifth Juvenile District;
38 (6) one juvenile judge in the Sixth Juvenile District;
39 (7) two juvenile judges in the Seventh Juvenile District; and
40 (8) one juvenile judge in the Eighth Juvenile District.
41 Section 3. Effective date.
42 This act takes effect on July 1, 2002.
