    Chair Eastman called the meeting to order at 3:45 p.m.
    
     MOTION: Sen. Bramble moved to approve minutes of the January 25, 2002 meeting.
    
    The motion passed unanimously with Sen. Poulton and Sen. Davis absent for the vote.
        
1.     S.B. 124 TIMELY PAYMENTS OF INSURANCE CLAIMS (Sen. J. Valentine)

    Sen. Valentine explained the bill.

     MOTION: Sen. Davis moved to amend the bill as follows:

1.     Page 2, Lines 31-32:    Delete ": (a)"

2.    Page 2, Line 33:    Delete "(i)" and insert "(a)" and after "policy;" bracket "or"

3.    Page 2, Line 35:    Delete "(ii)" and insert "(b)"

4.    Page 2, Line 37:    Delete line 37 and insert "(c) named, defined, or described:


        (i) as:
        (A) an insured;
        (B) a beneficiary;
        (C) a policyholder; or
        (D) otherwise covered person; and
        (ii) under the terms of:
"

5.    Page 2, Line 38:    Delete "(i)" and insert "(A)"

6.    Page 2, Line 39:    Delete "(ii)" and insert "(B)"
    
    The motion passed with Sen. Poulton and Sen. Bramble absent for the vote.
    
     MOTION: Sen. Mayne moved to pass S. B. 124 out of committee as amended.

2.     H.B. 23 MORTGAGES PRACTICE ACT REVISIONS
(Rep. G. Adair)

    
Rep. Adair presented the bill to the committee.

    MOTION: Sen. Mayne moved to pass H. B. 23 out of committee with a favorable recommendation.

    The motion passed unanimously.

3.    S.B. 119 WORKERS COMPENSAION INSURANCE RELATED AMENDMENTS     
(Sen. L. S. Poulton)

    Sen. Poulton presented the bill to the committee.

    Ron Casper, Small Business Association; Tom Bingham, Utah Manufacturing Association; Greg Fredde, Utah Mining Association; Ron Gardner, Fred A. Morton & Co.; Taylor Wray, Marsh, spoke to the bill.

    MOTION: Sen. Mayne moved to amend the bill as follows:

    Page 5, Lines 142 - 143:                             Bracket "at the rates established by the Division of Finance
         under Sections 63A-3-106 and 63A-3-107"


    The motion passed unanimously with Sen. Davis absent for the vote.

    MOTION: Sen. Mayne moved to pass S.B.119, as amended, out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Davis absent for the vote.

4.     S. B. 122 INSURANCE LAW AMENDMENTS (Sen. L. S. Poulton)

    Sen. Poulton explained the bill.

    Mike Sonntag, AIA, AAI, Bear River Mutual spoke in favor of the bill.

     MOTION: Sen. Mayne moved to adopt Sub. S.B. 122.

    The motion passed unanimously with Sen. Davis absent for the vote.

     MOTION: Sen. Mayne moved to pass Sub. S.B. 122 out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Bramble and Sen. Davis absent for the vote.

5.    H.B. 10 REPEAL OF INVESTMENT ADVISORY COMMITTEE (Rep. Winn)
    
    Rep. B. Winn presented the bill to the committee.

     MOTION: Sen. Mayne moved to pass H.B. 10 out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Davis absent for the vote.

6.     S.B. 102 BID REQUIREMENTS ON COUNTY OR MUNICIPAL CONSTRUCTION PROJECTS (Sen. H. Stephenson)

    
Sen. Stephenson ask the committee to hold the bill for a future meeting.

     MOTION: Sen. Hellewell moved to go on to the next item on the agenda.

    The motion passed unanimously with Sen. Davis and Sen. Poulton absent for the vote.



6.     H.B. 11 REPEAL OF UTAH OCCUPATIONAL SAFETY AND HEALTH ADVISORY COUNCIL (Rep. D. Bush)

    MOTION:
Sen. Mayne moved to adopt 1st Sub. H.B. 11.

    The motion passed unanimously with Sen. Poulton and Sen. Davis absent for the vote.

     MOTION: Sen. Mayne moved to pass 1st Sub. H. B. 11 out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Poulton and Sen. Davis absent for the vote.

7.     H.B. 49 MUNICIPAL PLAN FOR MODERATE INCOME HOUSING (Rep. P. Ray)

    Rep. Ray asked the committee to hold the bill for a future meeting.

    MOTION:
Sen. Hellewell moved to adjourn.

    The motion passed unanimously with Sen. Davis and Sen. Poulton absent for the vote.
