Third Substitute H.B. 5004

Senator Peter C. Knudson proposes the following substitute bill:

SALARIES FOR LEGISLATORS

2002 FIFTH SPECIAL SESSION

             5      This act modifies statutes governing salaries for the Legislature by reducing legislative
             6      salaries to 2000 levels from July 1, 2002 through December 31, 2002, and by directing that
             7      the resulting savings be deposited into the General Fund. This act takes effect immediately
             8      and has retrospective operation to July 1, 2002.
             9      This act affects sections of Utah Code Annotated 1953 as follows:
             10      AMENDS:
             11          63-55-236, as enacted by Chapter 164, Laws of Utah 1991
             12      ENACTS:
             13          36-2-2.1, Utah Code Annotated 1953
             14      Be it enacted by the Legislature of the state of Utah:
             15          Section 1. Section 36-2-2.1 is enacted to read:
             16          36-2-2.1. Salaries of members -- July-December 2002 only.
             17          (1) Notwithstanding any other requirement of this chapter, for the period beginning July
             18      1, 2002 and ending December 31, 2002 only, the salary of members of the Legislature is reduced
             19      to $100, the salary level for calendar year 2000, for each calendar day that the legislator attends
             20      veto-override and special sessions and other authorized legislative meetings.
             21          (2) The Legislature, the Office of Legislative Fiscal Analyst, and the Division of Finance
             22      shall ensure that monies saved from this salary reduction be deposited in the General Fund.
             23          Section 2. Section 63-55-236 is amended to read:
             24           63-55-236. Repeal dates, Title 36.
             25          (1) Section 36-2-2.1 is repealed January 1, 2003.


             26          (2) Title 36, Chapter 17, Legislative Process Committee, is repealed July 1, 2005.
             27          Section 3. Effective date -- Retrospective operation.
             28          If approved by two-thirds of all members elected to each house this act takes effect upon
             29      approval by the governor, or the day following the constitutional time limit of Utah Constitution
             30      Article VII, Section 8, without the governor's signature, or in the case of a veto, the date of veto
             31      override, and has retrospective operation to July 1, 2002.
