5 This act modifies the State System of Higher Education Code by authorizing the presidents
6 of institutions of higher education and the State Board of Regents to reallocate designated
7 appropriations between line items. This act has an immediate effective date.
8 This act affects sections of Utah Code Annotated 1953 as follows:
9 ENACTS:
10 53B-2-108, Utah Code Annotated 1953
11 Be it enacted by the Legislature of the state of Utah:
12 Section 1. Section 53B-2-108 is enacted to read:
13 53B-2-108. Appropriations reallocation.
14 (1) Notwithstanding the requirements of Title 63, Chapter 38, Budgetary Procedures Act,
15 appropriations for the support of higher education for the fiscal year beginning July 1, 2002 and
16 ending June 30, 2003, may be reallocated between line items as provided in this section.
17 (2) (a) The president of the University of Utah may reallocate between line items the
18 appropriations:
19 (i) described in Items 141-149 in S.B. 1, 2002 General Session; and
20 (ii) as modified by supplemental appropriations, including H.B. 4001, 2002 Fourth Special
21 Session and H.B. 5009, 2002 Fifth Special Session.
22 (b) The total amount of money reallocated may not exceed the sum of the reductions made
23 in the supplemental appropriations.
24 (3) (a) The president of Utah State University may reallocate between line items the
25 appropriations:
26 (i) described in Items 150-159 in S.B. 1, 2002 General Session; and
27 (ii) as modified by supplemental appropriations, including H.B. 4001, 2002 Fourth Special
28 Session and H.B. 5009, 2002 Fifth Special Session.
29 (b) The total amount of money reallocated may not exceed the sum of the reductions made
30 in the supplemental appropriations.
31 (4) (a) The president of Weber State University may reallocate between line items the
32 appropriations:
33 (i) described in Items 160 and 161 in S.B. 1, 2002 General Session; and
34 (ii) as modified by supplemental appropriations, including H.B. 4001, 2002 Fourth Special
35 Session and H.B. 5009, 2002 Fifth Special Session.
36 (b) The total amount of money reallocated may not exceed the sum of the reductions made
37 in the supplemental appropriations.
38 (5) (a) The president of Southern Utah University may reallocate between line items the
39 appropriations:
40 (i) described in Items 162-164 in S.B. 1, 2002 General Session Chapter 334, Laws of Utah
41 2001; and
42 (ii) as modified by supplemental appropriations, including H.B. 5009, 2002 Fifth Special
43 Session.
44 (b) The total amount of money reallocated may not exceed the sum of the reductions made
45 in the supplemental appropriations.
46 (6) (a) The president of Snow College may reallocate between line items the
47 appropriations:
48 (i) described in Items 165-167 in S.B. 1, 2002 General Session; and
49 (ii) as modified by supplemental appropriations, including H.B. 5009, 2002 Fifth Special
50 Session.
51 (b) The total amount of money reallocated may not exceed the sum of the reductions made
52 in the supplemental appropriations.
53 (7) (a) The president of Dixie State College may reallocate between line items the
54 appropriations:
55 (i) described in Items 168-170 in S.B. 1, 2002 General Session; and
56 (ii) as modified by supplemental appropriations, including H.B. 5009, 2002 Fifth Special
57 Session.
58 (b) The total amount of money reallocated may not exceed the sum of the reductions made
59 in the supplemental appropriations.
60 (8) (a) The president of the College of Eastern Utah may reallocate between line items the
61 appropriations:
62 (i) described in Items 171-174 in S.B. 1, 2002 General Session; and
63 (ii) as modified by supplemental appropriations, including H.B. 5009, 2002 Fifth Special
64 Session.
65 (b) The total amount of money reallocated may not exceed the sum of the reductions made
66 in the supplemental appropriations.
67 (9) (a) The president of Utah Valley State College may reallocate between line items the
68 appropriations:
69 (i) described in Items 175 and 176 in S.B. 1, 2002 General Session; and
70 (ii) as modified by supplemental appropriations, including H.B. 5009, 2002 Fifth Special
71 Session.
72 (b) The total amount of money reallocated may not exceed the sum of the reductions made
73 in the supplemental appropriations.
74 (10) (a) The president of Salt Lake Community College may reallocate between line items
75 the appropriations:
76 (i) described in Items 177-179 in S.B. 1, 2002 General Session; and
77 (ii) as modified by supplemental appropriations, including H.B. 5009, 2002 Fifth Special
78 Session.
79 (b) The total amount of money reallocated may not exceed the sum of the reductions made
80 in the supplemental appropriations.
81 (11) (a) The State Board of Regents may reallocate between line items the appropriations:
82 (i) described in Items 180-189 in S.B. 1, 2002 General Session; and
83 (ii) as modified by supplemental appropriations, including H.B. 5009, 2002 Fifth Special
84 Session.
85 (b) The total amount of money reallocated may not exceed the sum of the reductions made
86 in the supplemental appropriations.
87 Section 2. Effective date.
88 If approved by two-thirds of all the members elected to each house, this act takes effect
89 upon approval by the governor, or the day following the constitutional time limit of Utah
90 Constitution Article VII, Section 8, without the governor's signature, or in the case of a veto, the
91 date of veto override.
