First Substitute H.B. 71

Representative Gregory H. Hughes proposes the following substitute bill:

STATE APPROPRIATIONS AND TAX LIMITATION STUDY

             2     
2003 GENERAL SESSION

             5      This act mandates that the Legislative Management Committee direct a committee to
             6      study and make recommendations to the Legislature about the State Appropriations and
             7      Tax Limitation Act.
             8      This act enacts uncodified material.
             9      Be it enacted by the Legislature of the state of Utah:
             10          Section 1. Appropriations and tax limitation study.
             11          The Legislative Management Committee shall direct that the Executive Appropriations
             12      Committee, or another committee or subcommittee:
             13          (1) review the original intent and legislative history of Title 63, Chapter 38c, State
             14      Appropriations and Tax Limitation Act;
             15          (2) review subsequent amendments made to the act since it was enacted;
             16          (3) analyze, using historical revenue and budget data, the effect on Utah's budget and
             17      the state's fiscal condition:
             18          (a) if the limits would have been applied as enacted;
             19          (b) if the limits would have been applied without exemptions; and
             20          (c) under the current law;
             21          (4) review appropriation limits that are in place in other states, particularly Colorado,
             22      to determine whether or not those limits should be adopted in Utah; and
             23          (5) after completing a comprehensive review, recommend to the Legislature that Title
             24      63, Chapter 38c, State Appropriations and Tax Limitation Act, be either:
             25          (a) retained without change;



             26          (b) relaxed;
             27          (c) strengthened; or
             28          (d) repealed.
