APPROVAL OF MINUTES:

    MOTION:
Sen. Allen moved to approve the minutes of February 20th 2003.


     The motion passed with Sen. Stephenson and Sen. Waddoups absent at the time of the vote.

1.     S.B. 188 FUEL TAX CREDIT (Sen. S. Jenkins)

    
Sen. Jenkins presented the bill to the committee.
    
     MOTION: Sen. Bell moved to amend the bill as follows:

1.    Page 1, Line 11:    Delete "refund" and insert "discharge"

2.    Page 2, Line 54:    Delete "receipt of the notice of" and insert "the date of the"

3.    Page 3, Line 70:    Delete "a refund" and insert "the discharge"

4.    Page 5, Line 127:    Delete "receipt of the notice of" and insert "the date of the"

5.    Page 5, Line 143:    Delete "a refund" and insert "the discharge"

    The motion passed unanimously with Sen. Stephenson and Sen. Waddoups absent at the time of the vote.

    John Hill, Director, UPMRA, spoke to the bill.

    MOTION: Sen. Allen moved to pass S. B. 188, as amended, out of committee with a favorable recommendation.

    The motion passed unanimously with Sen. Stephenson and Sen. Waddoups absent at the time of the vote.

    Sen. Bell assumed the chair.

2.     S.B. 175 REVENUE PROCEDURES AND CONTROL ACT AMENDMENTS (Sen. C. Bramble)

    
Sen. Bramble presented the bill to the committee.

    Kim Thorne, Director DAS/Finance and Bruce Johnson, Commissioner, Utah Tax Commission, spoke to the bill.

    MOTION: Sen. Bramble moved to pass S. B. 175 out of committee with a favorable recommendation.


    The motion passed unanimously with Sen. Stephenson and Sen. Waddoups absent at the time of the vote.

3.     S.B. 209 REGISTRATION FOR ATV'S AND NONAUTOMOBLILES (Sen. C. Bramble)

    
Sen. Bramble presented the bill to the committee.

     MOTION: Sen. Bramble moved to amend the bill as follows:

1.    Page 1, Line 13;    Delete " October 1, 2003" and insert " January 1, 2004"

2.    Page 6, Line 164;    Delete "October 1, 2003" and insert "January 1, 2004"

    The motion passed unanimously with Sen. Stephenson and Sen. Waddoups absent at the time of the vote.

    Lee Gardner, Salt Lake County Assessor and Rod Marrelli, Utah Tax Commission, spoke to the bill.

    MOTION: Sen. Bramble moved to pass S.B. 209, as amended, out of committee with a favorable recommendation.

    The motion passed with Sen. Waddoups absent at the time of the vote.     
4.     H.B. 221 EXTENDING THE SALES AND USE TAX EXEMPTION FOR POLLUTION CONTROL FACILITIES (Rep. D. Ure)

    Sen. Bramble presented the bill to the committee.

    Greg Freedee, Utah Mining Association, and Tom Bingham, Utah Manufacturing Association, spoke to the bill.

    MOTION: Sen. Bramble moved to pass H.B. 221 out of committee with a favorable recommendation.

    The motion passed with Sen. Waddoups absent for the vote.

5.     S.B. 172 HAZARDOUS WASTE REGULATION AND TAX POLICY TASK FORCE AND MORATORIUM ON ACCEPTANCE OF CLASS B AND C RADIOAC TIVE WASTE     (Sen. C. Bramble)


    
Sen. Bramble presented the bill to the committee .

    Jason Groenewold, HEAL UTAH; Claire Geddes, Legislative Watch; Jerry Roos, citizen, and Steve Erickson, Sierra Club, spoke in opposition to the bill.

    MOTION: Sen. Blackham moved to pass S. B. 172 out of committee with a favorable recommendation.

    The motion passed with Sen. Waddoups voting against.

    Sen. Bramble assumed the chair.

6.     S. B. 225 LIMITATION OF JUDGEMENTS AGAINST GOVERNMENT ENTITIES (Sen. L. Blackham)

    
Sen. Blackham presented the bill to the committee.

    Gary Crane, Attorney, Layton City; and Roger Tew, UAMP's, spoke to the bill.
    Edward Havas, President, Utah Trial Lawyers Association and Doug Mortenson, Legislative Affairs, Utah Trial Lawyers Association, spoke in opposition to the bill.     

     MOTION: Sen. Blackham moved to pass S. B. 225 out of committee with a favorable recommendation.

    The motion passed with Sen. Stephenson voting against.

     MOTION:
Sen. Allen moved to adjourn.

     The motion passed unanimously.

     Sen. Bramble adjourned the meeting at 6:31 p.m.
