             8      General Description:
             9          This bill authorizes the Department of Health to waive the asset test for Medicaid
             10      eligibility for most children in households with incomes below the federal poverty
             11      guidelines.
             12      Highlighted Provisions:
             13          This bill:
             14          .    provides that beginning July 1, 2004, and within appropriations from the
             15      Legislature, children who qualify for Medicaid under the provisions of 42 U.S.C.
             16      1396a do not need to undergo an asset test for Medicaid eligibility.
             17      Monies Appropriated in this Bill:
             18          None

             23          26-18-3.2, Utah Code Annotated 1953

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 26-18-3.2 is enacted to read:
             27          26-18-3.2. Medicaid -- Asset test.
             28          On or after July 1, 2004, and within appropriations from the Legislature, the
             29      department:
             30          (1) may provide for Medicaid eligibility for children who live in households below the

             31      federal poverty guidelines; and
             32          (2) may not impose an asset test for children who are Medicaid eligible under the
             33      provisions of 42 U.S.C. 1396a(l).
