                  LONG TITLE
                  General Description:
                      This bill modifies the Alcoholic Beverage Control Act to amend provisions related to the
                  unlawful use of certain forms of identification.
                  Highlighted Provisions:
                      This bill:
                      .    provides that it is a class A misdemeanor for a person to use certain forms of
                  identification with false information to:
                          .    procure alcoholic beverages or products;
                          .    gain admittance to a place where alcoholic beverages or products are sold or
                  consumed; or
                          .    obtain employment that may not be obtained by a minor; and
                      .    makes technical changes.

                      32A-1-301, as last amended by Chapter 161, Laws of Utah 2002
                 
                  Be it enacted by the Legislature of the state of Utah:
                      Section 1. Section 32A-1-301 is amended to read:


                       32A-1-301. Unlawful transfer or use of proof of age -- False information.
                      (1) (a) It is unlawful for a person to transfer that person's proof of age to any other
                  person to aid that person:
                      [(a)] (i) in procuring alcoholic beverages or products;
                      [(b)] (ii) to gain admittance to a place where alcoholic beverages or products are sold or
                  consumed; or
                      [(c)] (iii) to obtain any employment that under this title may not be obtained by a minor.
                      [(2)] (b) Any person who permits that person's proof of age to be used by another for any
                  purpose stated in [this section] Subsection (1)(a) is guilty of a class B misdemeanor.
                      (2) (a) It is unlawful for a person to use a proof of age containing false information with
                  the intent to:
                      (i) procure alcoholic beverages or products;
                      (ii) gain admittance to a place where alcoholic beverages or products are sold or
                  consumed; or
                      (iii) obtain any employment that under this title may not be obtained by a minor.
                      (b) A person who violates this Subsection (2) is guilty of a class A misdemeanor.
