First Substitute H.B. 63

IDENTIFICATION OF STOLEN FIREARMS

             6      LONG TITLE
             7      General Description:
             8          This bill modifies provisions related to the receipt of firearms by pawnbrokers.
             9      Highlighted Provisions:
             10          This bill:
             11          .    requires a pawnbroker to request a National Crime Information Center stolen
             12      firearm check on a used firearm prior to its purchase by the pawnbroker;
             13          .    requires the Criminal Investigations and Technical Services Division of the
             14      Department of Public Safety to provide the pawnbroker with the results of the
             15      National Crime Information Center check; and
             16          .    requires the division to inform the law enforcement agency in the jurisdiction where
             17      the pawnbroker is in business if the check confirms that the firearm is a stolen
             18      weapon.

             27      Be it enacted by the Legislature of the state of Utah:
             28          Section 1. Section 11-6-1.5 is enacted to read:
             29          11-6-1.5. Stolen firearm checks.
             30          (1) A pawnbroker may not purchase a used firearm from an individual until the
             31      pawnbroker:
             32          (a) has made a request by telephone or other electronic means to the Criminal
             33      Investigations and Technical Services Division of the Department of Public Safety for a
             34      National Crime Information Center stolen firearm check; and
             35          (b) receives notice from the division as to whether the used firearm is a stolen firearm.
             36          (2) A request for a stolen firearm check under this section shall include the serial
             37      number of the firearm.
             38          (3) If the National Crime Center Information Center check on a used firearm discloses
             39      that the firearm is a stolen firearm, the division shall inform the law enforcement agency in the
             40      jurisdiction where the pawnbroker is in business.
             41          (4) For purposes of this section, "purchase" includes to advance money on the firearm.
