             8      General Description:
             9          This bill modifies the Mobile Home Park Residency Act.
             10      Highlighted Provisions:
             11          This bill:
             12          .    provides a right of first refusal to a mobile home park residents' association prior to
             13      the sale of a mobile home park.
             14      Monies Appropriated in this Bill:

             22      Be it enacted by the Legislature of the state of Utah:
             23          Section 1. Section 57-16-17 is enacted to read:
             24          57-16-17. Sale of a mobile home park.
             25          (1) If a mobile home park residents' association has been formed within a mobile home
             26      park pursuant to Section 57-16-16 , the owner of the mobile home park shall comply with
             27      Subsection (2) prior to selling the mobile home park.


             28          (2) An owner of a mobile home park described in Subsection (1) shall:
             29          (a) provide written notice, including the sale price, terms, and conditions, through
             30      certified mail to the mobile home park residents' association if the owner receives an offer to
             31      purchase the mobile home park; and
             32          (b) sell the mobile home park to the mobile home park residents' association if, within
             33      45 calendar days after the day on which the owner sent the notice described in Subsection
             34      (2)(a) by certified mail, the mobile home park residents' association provides to the owner:
             35          (i) a fully executed purchase and sale agreement with a sale price, terms, and
             36      conditions at least as favorable to the owner as the offer contained in the notice described in
             37      Subsection (2)(a); and
             38          (ii) a deposit of money equal to at least 2% of the purchase price.
