7 LONG TITLE
8 General Description:
9 This bill modifies the New Motor Vehicles Warranties Act to include motorcycles as
10 covered vehicles.
11 Highlighted Provisions:
12 This bill:
13 . amends the definition of motor vehicles to include motorcycles S [ sold in this state ]
13a DESIGNED PRIMARILY FOR USE AND OPERATION ON PAVED HIGHWAYS s as
14 motor vehicles covered under the New Motor Vehicles Warranties Act.

23 Be it enacted by the Legislature of the state of Utah:
24 Section 1. Section 13-20-2 is amended to read:
25 13-20-2. Definitions.
26 As used in this chapter:
27 (1) "Consumer" means an individual who has entered into an agreement or contract for

the transfer, lease, or purchase of a new motor vehicle other than for purposes of resale, or
29 sublease, during the duration of the period defined under Section 13-20-5 .
30 (2) "Manufacturer" means manufacturer, importer, distributor, or anyone who is named
31 as the warrantor on an express written warranty on a motor vehicle.
32 (3) "Motor home" means a self-propelled vehicular unit, primarily designed as a
33 temporary dwelling for travel, recreational, and vacation use.
34 (4) (a) "Motor vehicle" includes:
35 (i) a motor home, as defined in this section, but only the self-propelled vehicle and
36 chassis sold in this state; [and]
37 (ii) a motor vehicle, as defined in Section 41-1a-102 , sold in this state[.]; and
38 (iii) a motorcycle, as defined in Section 41-1a-102, sold in this state S IF THE MOTORCYCLE
38a IS DESIGNED PRIMARILY FOR USE AND OPERATION ON PAVED HIGHWAYS s .
39 (b) "Motor vehicle" does not include:
40 (i) those portions of a motor home designated, used, or maintained primarily as a
41 mobile dwelling, office, or commercial space;
42 (ii) farm tractor, [motorcycle,] road tractor, or truck tractor as defined in Section
43 41-1a-102 ;
44 (iii) mobile home as defined in Section 41-1a-102 ; S [ or ] s
45 (iv) any motor vehicle with a gross laden weight of over 12,000 pounds, except a
46 motor home as defined under Subsection (3) S [ . ] ;
46a (v) A MOTORCYCLE, AS DEFINED IN SECTION 41-1A-102, IF THE MOTORCYCLE IS DESIGNED
46b PRIMARILY FOR USE OR OPERATION OVER UNIMPROVED TERRAIN;
46c (vi) AN ELECTRIC ASSISTED BICYCLE AS DEFINED IN SECTION 41-1A-102;
46d (vii) A MOPED AS DEFINED IN SECTION 41-6-1;
46e (viii) A MOTOR ASSISTED SCOOTER AS DEFINED IN SECTION 41-6-1; OR
46f (ix) A MOTOR-DRIVEN CYCLE AS DEFINED IN SECTION 41-6-1. s
