             6      LONG TITLE
             7      General Description:
             8          This bill modifies the exemptions from licensure provision of the Pharmacy Practice
             9      Act.
             10      Highlighted Provisions:
             11          This bill:
             12          .    provides an exemption from licensure as a pharmacy technician for an individual
             13      who works under the direct personal supervision of a licensed pharmacist in a retail
             14      pharmacy that fills less than 200 prescriptions on a daily basis; and
             15          .    makes certain technical changes.

             22          58-17a-305, as last amended by Chapter 160, Laws of Utah 2000

             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 58-17a-305 is amended to read:
             26           58-17a-305. Exemptions from licensure.
             27          In addition to the exemptions from licensure in Section 58-1-307 :



             28          (1) an individual who has completed all qualifications for licensure as a pharmacy
             29      technician, except an experience requirement which may be established by rule under
             30      Subsection 58-17a-302 (4), may practice under the direct personal supervision of a pharmacist
             31      while completing that requirement for a period not to exceed six consecutive months without
             32      being licensed under this chapter; [and]
             33          (2) an individual who works under the direct personal supervision of a licensed
             34      pharmacist in a retail pharmacy that fills less than 200 prescriptions on a daily basis may
             35      engage in the practice as a pharmacy technician without being licensed under Section
             36      58-17a-301 in accordance with division rule made in collaboration with the board; and
             37          [(2)] (3) [a person] an individual may sell contact lenses in accordance with Section
             38      58-16a-801 without being licensed under this chapter.
