             7      LONG TITLE
             8      General Description:
             9          This bill amends age requirement provisions for obtaining certain fishing and hunting
             10      licenses.
             11      Highlighted Provisions:
             12          This bill:
             13          .    allows 11-year-old persons to obtain a combination license to hunt small game and
             14      fish if their 12th birthday falls within the calendar year for which the license is
             15      issued;
             16          .    allows 11-year-old persons to obtain a cougar or bear hunting permit if their 12th
             17      birthday falls within the calendar year for which the hunting permit is issued;
             18          .    allows 11-year-old persons to obtain a small game hunting license if their 12th
             19      birthday falls within the calendar year for which the license is issued;
             20          .    allows a person 12 years of age or older, and in certain circumstances, 11-year-old
             21      persons, to obtain a turkey hunting permit; and
             22          .    provides that $1 of each resident's turkey hunting fee be used for the hunters
             23      education program.

             35          23-19-22.6, Utah Code Annotated 1953

             37      Be it enacted by the Legislature of the state of Utah:
             38          Section 1. Section 23-19-17 is amended to read:
             39           23-19-17. Resident fishing and hunting license -- Use of fee.
             40          (1) A resident 12 years of age or older, upon payment of the fee prescribed by the
             41      Wildlife Board, may receive a combination license to fish and to hunt for small game as
             42      provided in the rules of the Wildlife Board.
             43          (2) A person 11 years of age, upon payment of the fee, may obtain a license to fish and
             44      to hunt small game if that person's 12th birthday falls within the calendar year in which the
             45      license is issued.
             46          [(2)] (3) One dollar of the combination license fee shall be used for the hunter
             47      education program in any of the following:
             48          (a) instructor and student training;
             49          (b) assisting local organizations with development;
             50          (c) maintenance of existing facilities; or
             51          (d) operation and maintenance of the hunter education program.
             52          [(3)] (4) (a) Fifty cents of the combination license fee shall be used for the upland
             53      game program as follows:
             54          (i) to acquire pen-raised birds; or
             55          (ii) to capture and transplant upland game species.
             56          (b) The combination license fee revenue designated for the upland game program by



             57      Subsection [(3)] (4)(a) is in addition to any combination license fee revenue that may be used
             58      for the upland game program as provided by Sections 23-19-43 and 23-19-47 .
             59          Section 2. Section 23-19-22.5 is amended to read:
             60           23-19-22.5. Cougar or bear hunting permit.
             61          (1) A person 12 years of age or older, upon [paying] payment of the fee prescribed by
             62      the Wildlife Board, may receive a permit to take cougar or bear as provided by rules of the
             63      Wildlife Board.
             64          (2) A person 11 years of age, upon payment of the fee, may obtain a permit to hunt
             65      cougar or bear if that persons's 12th birthday falls within the calendar year in which the permit
             66      is issued.
             67          [(2)] (3) One dollar of each cougar or bear permit fee collected from a resident shall be
             68      used for the hunter education program.
             69          Section 3. Section 23-19-22.6 is enacted to read:
             70          23-19-22.6. Turkey hunting permit.
             71          (1) A person 12 years of age or older, upon payment of the fee, may receive a permit to
             72      take turkey as provided by rules of the Wildlife Board.
             73          (2) A person 11 years of age, upon payment of the fee, may obtain a permit to hunt
             74      turkey if that person's 12th birthday falls within the calendar year in which the permit is issued.
             75          (3) One dollar of each turkey permit fee collected from a resident shall be used for the
             76      hunter education program.
             77          Section 4. Section 23-19-25 is amended to read:
             78           23-19-25. Resident small game hunting license -- Use of fee.
             79          (1) A resident under the age of 14 years and 12 years of age or older, upon payment of
             80      the fee prescribed by the Wildlife Board, may receive a license to hunt small game.
             81          (2) A person 11 years of age, upon payment of the fee, may obtain a license to hunt
             82      small game if that person's 12th birthday falls within the calendar year in which the license is
             83      issued.
             84          [(2)] (3) One dollar of the small game hunting license fee shall be used for the hunter
             85      education program.
             86          [(3)] (4) (a) Fifty cents of the small game hunting license fee shall be used for the
             87      upland game program as follows:


             88          (i) to acquire pen-raised birds; or
             89          (ii) to capture and transplant upland game species.
             90          (b) The small game license fee revenue designated for the upland game program by
             91      Subsection [(3)] (4)(a) is in addition to any small game license fee revenue that may be used
             92      for the upland game program as provided by Sections 23-19-43 and 23-19-47 .
             93          Section 5. Section 23-19-26 is amended to read:
             94           23-19-26. Nonresident small game hunting license -- Use of fee.
             95          (1) A nonresident 12 years of age or older, upon payment of the fee prescribed by the
             96      Wildlife Board, may receive a license to hunt small game.
             97          (2) A nonresident 11 years of age, upon payment of the fee, may obtain a license to
             98      hunt small game if that person's 12th birthday falls within the calendar year in which the
             99      license is issued.
             100          [(2)] (3) (a) Fifty cents of the small game hunting license fee shall be used for the
             101      upland game program as follows:
             102          (i) to acquire pen-raised birds; or
             103          (ii) to capture and transplant upland game species.
             104          (b) The small game license fee revenue designated for the upland game program by
             105      Subsection [(2)] (3)(a) is in addition to any small game license fee revenue that may be used
             106      for the upland game program as provided by Sections 23-19-43 and 23-19-47 .
             107          Section 6. Coordinating S.B. 138 with H.B. 235.
             108          If this S.B. 138 and H.B. 235, Turkey Hunting Permits, both pass, it is the intent of the
             109      Legislature that the amendments made to Section 23-19-22.6 in this bill shall supercede the
             110      amendments made to Section 23-19-22.6 in H. B. 235.
