Sen. B. Evans called the meeting to order at 8:07 a.m.

1.    S.B. 179 EXPEDITED APPEALS IN CHILD WELFARE CASES (Sen. L. Hillyard)

    Sen. Hillyard presented the bill to the committee.

     MOTION: Sen. Thomas moved to amend the bill as follows:

1.    Page 3, Lines 64 through 66 :    

             64          (b) Claims of ineffective assistance of counsel do not constitute extraordinary
             65      circumstances. If a claim is raised by trial counsel
  or a party       , it must be included in the petition on

             66      appeal.

    The motion passed unanimously.

    Carol Verdoia, Assistant Attorney General, spoke to the bill.

    Sen. J. Evans assumed the chair.
    
     MOTION: Sen. Allen moved to pass S. B. 179, as amended, out of committee with a     favorable recommendation.
    The motion passed unanimously.



2.     H.B. 174 FORENSIC MENTAL HEALTH AMENDMENTS (Rep. J. Seitz)

    
Rep. Seitz presented the bill to the committee.

    Mark Payne, Utah State Hospital, spoke to the bill.
          MOTION: Sen. Allen moved to pass H. B. 174 out of committee with a favorable recommendation.

    The motion passed unanimously.
    
    MOTION: Sen. Allen moved to place H. B. 174 on the Consent Calendar

    The motion passed unanimously.

3.    S.B. 64 RURAL HEALTH CARE INITIATIVE (Sen. J. Hickman)

    
The bill was not considered.
