LONG TITLE
General Description:
This bill modifies the Motor Vehicles Code by enacting a provision related to operating
a motor vehicle near a bicycle.
Highlighted Provisions:
This bill:
. prohibits an operator of a motor vehicle from knowingly, intentionally, or recklessly
operating a motor vehicle within three feet of a moving bicycle, unless the operator
of the motor vehicle operates the motor vehicle within a reasonable and safe
distance of the bicycle.
Monies Appropriated in this Bill:
This bill appropriates $20,000 from the General Fund to the Utah Highway Patrol for a
public education campaign to promote bicycle safety.

Be it enacted by the Legislature of the state of Utah:
Section 1. Section 41-6a-706.5 is enacted to read:
41-6a-706.5. Operation of motor vehicle near bicycle prohibited.
An operator of a motor vehicle may not knowingly, intentionally, or recklessly operate a
motor vehicle within three feet of a moving bicycle, unless the operator of the motor vehicle
operates the motor vehicle within a reasonable and safe distance of the bicycle.
Section 2. Appropriation.
There is appropriated from the General Fund for fiscal year 2005-06, a one-time
appropriation of $20,000 to the Utah Highway Patrol for a public education campaign to promote
bicycle safety.
